    So went down to serve a breach for non payment if rent.

    Looked like the property was abandoned boxes and boxes of stuff near the bins. No cars at property and the lawn and gardens overgrown.

    Looked through windows and couldn't see if the place was abandoned as blinds were shut. Knocked on door repeatedly. No answer until I heard a toddler crying. So I went in the front door to find a 3 year old surrounded by absolute filth. I said where's mummy and daddy he said at work. I asked a couple of times and he kept saying at work.

    I went back outside as I saw a police car driving past for the second time and called out for them to stop. Then I hear a cry from inside.

    Mum was in there under all the filth, naked and out of it. Drug paraphernalia everywhere and crap everywhere. Property unrecognisable. Felt so sad for the kid.

    Served the breach and left. Will send a breach for the damaged property tonight. Department of commerce says that there is nothing else I can do for 14 days.

    The smell was horrendous. I'm insured but know this is going to get costly. But the poor kid has a sad future in front of him.

    I've seen a multi-part series a bit like that. Poor child, odds aren't great.

    That's so sad. We had to kick non-paying druggies out of our house too - thankfully there's minimal damage to the property. Just dirty and buggy.
    They had gorgeous little kids too, it makes me sad knowing the likely future they have before them.

    Mine wasn't. There wasn't any evidence until the very end, and we had a very long wait to get to court - had our hearing in June but could only see the magistrate in August! when they finally left we could see some rewiring in the ceiling, a pipe poking through a hole in the cornice and all the vents and airholes were taped up. The PM had her suspicions but we couldn't get them out, despite having no rent since April and an ended lease in July. :eek:
    I don't think it was as desperate as @sammmeee situation.

    Shouldn't you call Docs or whoever the relevant dept is in your state about the neglected kid?

    The cops will report the mother/parents to Child Protection.... in fact they probably took the kid with them.

    If this is in WA, you could possibly also issue a breach notice for illegal use of premises, and failure to keep the place reasonably clean.

    Also, there is a faster process to terminate for rent arrears that doesn't require a breach notice - you could issue a notice of termination immediately.

    Arguably it was an emergency, which is a right of entry under the Act.

    I hope the police are onto it.

    It's such a sad predicament - that poor kid would have seen a lot in their short three years.

    That's not true. You can't inspect without notice, but you can certainly visit to hand notices over.

    Yep, Im legally within my rights to hand the breach notice direct to the tenant. Sending breach notice 20 today for the state of property and also a notice of inspection. When I left the boyfriend rocked up, I wasn't hanging around. But definitely shaken by what I saw..my house is now a shooting gallery...
