Hi all, Newbie question here Just trying to understand minimum lot size requirements and how they work With that being 400m2 or according to LEP Does that mean if you build a duplex or multiple dwellings on a 500m2 block, that you're unable to subdivide that and sell as two separate lots (being 500 / 2 = 250m2)? Or does that mean you're unable to develop on anything smaller than 400m2? Thanks in advance

If it is strata titled townhouses, they don't work off min lot sizes. I think you are confused between a townhouse, dual occupancy and freestanding dwellings...

View - NSW legislation Have a read of that, that is 'planning law' with a small degree of flexibility. When I use the world flexibility its based on merit. Townhouses don't have min lot sizes, but not to 'any size' you need to be clear in what your 'hypothetical' situation is. You can't have a 2 bedroom townhouse at 50m2 as it would go against building codes, fire safety and the like. Most of which is outlined in DCP ' Development Control Plans'.
Newcastle LEP quoted below. 200m2 is the smallest you can go with a Torres title lot under the Newcastle LEP, but you need to meet requirements such as private open space, setbacks, minimum width etc. Best point of call would be a Town Planner local and familiar with the LEP/Council
All good advice here so far. Two points to focus on, the min lot size is for a Torrens title sub division. Also the min lots size within a council area can change according to the LEP min lot size mapping. So one suburb may be different to the next, even in the same council. www.developmentapprovals.com.au
