minimum lot size for duplex

    Hi,

    -what is the minimum lot size needed to have a dual occupancy CDC ?( Bayside council NSW),
    I checked the LEP it says min. 350 m2 per individual lot(which means 700 m2 parent lot) however in the low rise diversity code its 400 m2 for the parent lot?
    -the same question in Campbelltown council can we build a duplex CDC on a 610 m2 land (LEP states min 700 parent lot and min.300 individual lot)?

    Low rise diversity code SEPP respects any min lot provisions in an LEP so the LEP takes precedence.

    Lot subdivision is usually in section 4 of the relevant LEP. For Campbelltown, it's here.

    I have heard I don’t need to meet the the min lot size if I do a strata subdivision is that correct?where can I find information about that.

    Did you have a look at section 4.1 that I linked to? In that section, you will find
    4.1AA Minimum subdivision lot size for community title schemes

    Under clause 2:
    (2) This clause applies to a subdivision (being a subdivision that requires development consent) under the Community Land Development Act 1989 of land in any of the following zones—
    (a) Zone RU2 Rural Landscape,
    (b) Zone R2 Low Density Residential,
    (c) Zone R3 Medium Density Residential,
    (d) Zone R5 Large Lot Residential,
    (e) Zone E3 Environmental Management,
    (f) Zone E4 Environmental Living,
    but does not apply to a subdivision by the registration of a strata plan.
