House & Home Man dies after 'breaking into home' in Newcastle and being detained by homeowner

    From reports it would appear that the issue is that the intruder was chased out of the property and on to the street before the incident that led to death took place.

    Had it happened in the house outside the child's room then the situation would be different.

    The true facts will unfold if it goes to court.

    I woke up to the sound of someone exiting my house last november. I ran outside but was too slow to wake up and realise what it was I was hearing. I grabbed my dog, jumped in the car and did a lap of the block, but by the time I came out on to my street again the cops were already on my street, someone had rang about the same person being in their backyard a little earlier.

    I can tell you right now the state of mind I was in, how ****** off I was that they had pretty much gone into my sleeping sons room I could have very easily ended up in this persons position. It's really not a nice thing to go through

    The cops got their dog out to my house and traced him back to his own house and retrieved my laptop, my wallet and the partners handbag.

    Well they reckon he and his neighbour (who hasnt been charged) chased the alleged offender out onto the street and got into a fight which apparently broke the alleged offenders neck?

    I see the family of the deceased saying he was only looking for a party and got the wrong address.

    If this is the case, then self defence wouldn't apply I guess, as there was no longer a threat to himself, his family, or his property. It would be a shame however for the bloke to cop a criminal conviction when trying go affect a citizens arrest as he is entitled to do, but not having the skills or training, and allegedly breaking the intruders neck.

    Either way, the only job police have is to investigate and bring all evidence to the court, it's then up to judge or jury to decide.

    How could you know he was trying to do a citizens arrest and not just flogging the intruder on the street?

    far too many assumptions being made in this thread imo.

    There's a petition getting around Facebook through that change.org rubbish to protect peoples right, to protect themselves from intruders!

    There maybe more to it... However i recall a few years back i think out at Villawood or Bankstown somewhere where the old guy ( i think his name by memory was Ron?)caught some bloke in his house on arriving back and the old bloke killed the intruder... Forget how it was done.. But he got charged with murder until it was dropped about a year later.

    Those two possibilities don't have to be mutually exclusive.

    But the fact two men were trying to detain the intruder was first released by police in their media release archives and then reported by media.

    I believe detain here is interchangeable to 'arrest' hence referring to s100 of LEPRA - power of other persons to arrest without warrant, commonly known as "citizens arrest".

    But yes, we lot can only assume I suppose until the facts become public record.

    Yes. The alleged burglar that died after a confrontation with the resident in Newcastle. Burglar had a long criminal history like wategos said, family says he was gentle giant looking for a party
