Is it normal to have a final sunset date?

    Hi All,

    Want to get some feedback regarding a final sunset date clause, i have an OTP that is currently in development. The initial sunset clause was September 2019 but iv'e been advised by my lawyer that the developer has the right to extend the sunset to January 2020 due to a "final sunset clause" is this normal?

    Normal isnt the point. If its in the contract and you signed it....

    Read the contract looking for special conditions around the Sunset clause or completion dates. Or ask your solicitor to direct you to the appropriate section and explain it to you. It'll be in there somewhere.

    Are you actually wanting a way out of the contract?

    Some off the plan contracts have a special condition that allows for this. It is not common however I have seen a few over the years. You should look for the clause it will be in the special conditions.
