Is building without permit a criminal offence

    Thank you everyone for your input and support.

    I was sent a building notice and I'm going to comply with them and hopefully it all goes well.

    A good big lesson to learn here.

    I will check all the drawings and permits from now on, before purchase.
    Planning and clarification before any improvement projects
    7 years rule doesn't exist
    And if someone freaks out because they're ignorant Id be patient and supportive and help them through a difficult event, just like you guys have done for me

    What exactly have you been asked to do by Council?

    Just remove the deck/verandah you added on or the entire granny flat?

    I was asked to remove everything, to make sure the granny flat is not going to be used.

    Ouch, hopefully not costing you too much. I would have thought just taking out the sink would make the granny flat not classify as a dwelling. Have you sought your own independent advice?

    I decided to just go ahead and do it. We're just going to try to do everything to make it right.

    Did council say that the granny flat was new enough to need a permit/or that it needs a dependent person and must therefore be removed?

    It will be way too large to be classed as a garden shed, so yes it is a granny flat.

    Yes, but depending on a few factors - largely age - it may not be classified as a DPU In Vic in the current sense where it would need to be removed.

    I wouldn't stress - Google brimbank council. Can't say too much on a public forum but a Google search will tell all.

    Can you PM me please on what that means? My searches turn up nothing other than the services Brimbank provides and other boring stuff (neither good or bad).

    Approximately 9 years ago the state government had to sack brimbank council for major corruption and appoint administraters. The ombudsman report are online, which outlines the several cases of corruption.

    OK - it was very well publicised at the time - bunch of out of control elected councilors.

    The ombudsman's report found Brimbank Council (I.e. the councilors) was dysfunctional and plagued by factional and political allegiances.

    Not sure how it’s relevant to the OP though?
