Identification survey prior to purchasing a property in Sydney

    Hi,

    Is it usual to do an identification survey prior to purchasing a property in Sydney? Are there certain signs which leads to making sure one is conducted?

    I understand the purpose is to check for any easements, any irregularities in the boundaries and/or encroachment. What happens if there are irregularities?

    not so common these days for residential properties as "title insurance" is now offered by insurance companies.
    I'm not sure what they cover, but they will certainly take your money and hope nothing crops up in the future.

    best to seek guidance from your legal representative.

    however a concise survey report will identify all the things you have mentioned amongst others,
    • the property being purchased or mortgaged, as described in the Contract of Sale
    • encroachments by buildings fences or other improvements (if any)
    • easements, burdened or appurtenant to the property
    • whether the position of buildings relative to the boundaries comply with the Local Government Act and relevant ordinances.
    • if any building or other covenants to which the land in the title may be subject, and whether such covenants have been complied with.
    • whether the land is affected by any proposed realignment or Notice of Resumption.
    • discrepancies in dimensions (if any) by field survey as compared to the title deed or any other matters disclosed by survey or during the Surveyor's investigations which may affect the property.

    this information is given to your legal representative and they will assess if any further investigation or action is required therefore potentially avoiding any unforeseen issues further down the track.
