Software patents are hard to defend... Just look at Samsung vs apple drama.

Getting a patent is one that but defending it, cost money n time.

However, run it past patent lawyers, fee different way to register it.

Feel free to PM me, if you need recommendation.

I agree that a software patent is difficult to defend - but we might not have to. If the patent does get infringed, I would argue the value of the patent would increase. It could get sold to the people who infringe the patent or (better still) one of their competitors.

Anyway, we are talking to a patent specialist right now.

So we hope a patent would create equity in the startup and increase our leverage for venture capital. Our aim is to get VC.

This might give you the info your searching for. There are also various forums that deal with Patents and Trademarks etc.

I think there is an element to luck in all of this that should not be discounted. For every microsoft, there is an OS/2 warp. For every VHS, a betamax. For every facebook, a myspace. Think: Blu-ray/HD-DVD, Google/Altavista, Gumtree/quokka. In fact, it is said that 90% of startups fail. The question to ask is why did facebook suceed and myspace fail? Why did VHS succeed and Betamax fail? Is there an element of luck or was it something else? I don't know, but I'm not discounting luck as one factor in the mix.
