Help! What are Real estate agent's obligations?

    Good Afternoon I am hoping someone here can assist.

    We are currently trying to sell our Investment property in Perth and chose to use the agency that managed it as there is a tenant still in there.

    All was well when we signed up with the agent, (who happens to be the director) and paid the marketing costs. After this it seems to be going downhill. It takes over a week to get a response from the agent and he is not answering our questions about scheduling a home open. We were also charged for professional photos which they never took.

    The property has been on the market for 5 weeks and we have reduced the asking price to try and sell quicker as the tenants lease is nearly up.

    The agent also was in holiday for 3 weeks during this time which he didnt inform us of when signing up.

    Do agents have to host home opens or am I right in thinking he is lazy? It seems like realestate.com is doing the work and he is just waiting for a phonecall and easy commission.

    Can we get out of the contract due to bad service or use a different agent working for the same company? We feel he doesnt really care about trying to sell our property.

    Any help advice is greatly appreciated, before my wife goes in and tells him off.

    Cancel contract for non performance.

    Wait til lease finishes and spruce up property.

    Retry with new agent.

    Firstly, I would be asking for my money back paid for professional photographs if you didn't get them.

    Then I'd let the selling period finish and find an agent who will look after you. What they are doing is pathetic.

    Have you had a close look at the authority contract you signed? It should have some details about how to terminate the agreement.

    You might need legal advice on it if the agent doesn't let you out.
