Help required to deal with incompetent Builder

    We have contracted Jethsons builders, who was suppose to complete the job within 3 months as per contract and it is almost a year they are not close to even 50% of job. Asking for money all the time, claiming don't have money to pay for material. We have been paying him to get the work done but he does not turn up for weeks once he receives the payment. Does not follow payment schedule, threatens that if we don't pay work will not be done and tells us that it will take more than a year to resolve if we lodge complaint with tribunal. Need help who can advise how to deal with him and get the work done.It has already costed us lots of money in rent and interest as we can't move into the property. Please advise us what should we do in this situation.

    Lodge your complaint with fair trading - have a chat with the officer at the counter or over the phone first to find out what you can do to force the issue.

    Tell him you've filed a complaint with the Building services authority in your state and they are sending an inspector to look at the job, & you intend on getting someone else in to finish the job.

    Don't spin BS, do it! They've threatened to pull up stumps if you go to the OFT, don't tease/forewarn them - speak with an officer and get the complaints logged and mediated. Who is going to look worse - the complainant who has paid in a timely fashion or the builder who hasn't got sufficient funds to keep the business going & complete work?

    I was in similar situation a few years ago with my PPOR reno- hard lessons learnt :( as follow:
    • keep detailed diary - this will assist any legal/ regulatory parties to make your case
    • compile a gap review of his performance vs his obligations under contract from diary notes
    • do not pay ahead of staged payment schedule and get inspector to check prior to payments
    • have chat to builders subbies- usually in this situation they are not getting paid either- in my case they advised us of other clients who were in similar situation with builder so we pooled resources to pursue regulatory/ legal channels

    That sucks. Some people just suck.

    As crappy as Diy is, going through what you are dealing with would be so much worse.

    It seriously sometimes can be scary to think of these situations where tradies dont deliver.

    Yeah it would be horrible. When relying on tradies its completely out of your control.
