HELP BAD TENANT- Need Help please!

    Ladbrokes is running a book on the outcome. Ive gone all in on tenant still there Monday @ $1.05.

    Not as far I or the PM know !( or as the RTA/Qld have advised me!!)... I of course, 1st got mad about this, thinking "How dare HE tell me when he's leaving, he has to be gone by Thursday morning!" but they have told me "well if he says he's leaving Sunday, that's yr best shot of getting him out". Its not like I can go pull him out by the scruff of his neck & throw his stuff out after him, it still has to go to QCAT for a Termination Order if he doesn't go (hence my putting paperwork in now). So annoying that we landlords have to apply to get these abusive, NON rent payers out!

    I think the answer to him, if it had of been me, would have been, your deadline has passed, am moving to next stage of process. In reality, next stage would not happen before Sunday anyway, but then they know your following the process.

    Anyway, you will know soon enough, he may just go.

    OKay ... So the update to this u guys don't know about is this!!
    After talking to P.M who's helping me & RTA, decided to give him a letter with a offer. (Don't all yell at me!) Both said cant officially tell me to do it but that's what they would do in my shoes if it gets Douchebag out quicker. Offer was; of the 5 weeks rent he will be behind by this Friday, I will settle for 3 weeks rent (& electricity bill he owes) IF he leaves the house on Sunday, as he said, leaves it clean AND in the same condition it was when he moved in ( little wear & tear acceptable), no damage (remember he's not paid any bond) OR I will have to pursue him thru an order & I will be after all of the rent arrears, electricity that he refuses to pay,,any damage, plus my costs!
    So, went to put it in his letterbox ....and out he comes from the garage!! Shock Horror!! I say "Hi, letter for you in letterbox" & walk off. He says "can we talk for a min" I say yes & he says 'I'll be out on Sunday" "Ok & what about arrears, etc". He goes "what about them?" I say "Are you going to pay them?" He goes "Of course I am, I'll pay out of my wages this week & the house is going to be spotless for yr inspection "He looked very sheepish & NO sign of the nasty, screaming, insulting voicemail-leaving tenant from 2 weeks ago! It was like he knew the gig was up, he has to get out, & doing the wrong thing will only follow him!! So Im standing there thinking he's says he's gonna pay ALL the money & there's a letter saying I'll let him off for 2 weeks of that rent. Well.... I go back in letterbox & take letter back sooo quickly! (Ha Haaaa!!) He just stares at the envelope wondering! Phew !! Nearly did myself out of 2 weeks rent!
    So now THIS is why I think he'll be out on Sunday!! He's either very good at acting OR after bullying me for nearly the whole 6 months he's been there! (sending rude messages when asking for rent arrears, bond, power bill payment)- he has realized it didn't get him anywhere (but out of the property he wanted to stay in).
    So this is what the cops said about him thru their dealings with him... he's a conman, a liar & a bully- but he stays just the right side of the law but when push comes to shove he behaves himself! So I'm gonna take a few male friends with me when I go get the keys off him. ( And great :( have to get a locksmith on a Sunday).
    Plan to txt him tomorrow to arrange a time for Sunday & letting him know I'll be bringing along a friend or 2!

    Just put the rest of story from the other day - which is why I think he IS going Sunday!!
    (Yes I do think he's going ... phew) And I am starting the process... he wont find out til they contact him with it)

    Sounds like you are doing all you can and having him leave peacefully is a good result, considering things could be a lot worse.

    I may have already posted this, but when I had a similar situation, the local cops were going to come with me at 7.30am the morning after the midnight deadline. I called and cancelled them when I saw them moving on the day of the deadline.

    I had no tribunal order, just police who were happy to come with me and keep me safe. Perhaps let him know you've had advice from the police and they are happy to accompany you on Sunday to get the keys. That might just be enough to persuade him not to change his mind about moving Sunday.

    And if you need a locksmith, send me a PM. Don't just get one from the internet. I'd be using one that comes recommended. What suburb is this?

    Thanks Wylie, You'd posted a bit about it before! but I didn't know I may be able get the police to help without the Tribunal order... but that's a good idea about the police (without the order even -I might ring the one I talked to the other day, who knew him & see if he can suggest something I could do in case things get ugly!!

    Yayyyyy He's OUT!!!!!! HE's OUT!!!
    He's left a bit of a dirty mess & the carpets have splotchy stains all over them!!! But the FU^*£€&ERS OUT OF MY HOUSE! So much for leaving it "spotless" .... What a bloody joke !! He must have meant he would leave it " dirty & spotty" not spotless!!!
    The fridge has mouldy fruit in it, dirty oven, crumbs all over kitchen (hasn't been vacuumed , but tiled areas were mopped as they were still wet). A large shelving unit is missing from the garage! The black Garage floor has a large area with white paint spilled or dripped all over it! Other things missing too!! White resin Laundry tub has black melted molten patches like he's dropped something burning into it !!? UGGHHH!!! UGGGHH!! :mad::(:mad: Broken lock on a back screen door...but could still lock glass door there!
    Arrears NOT PAID.... SAYS he'll be "back to pay tomorrow ....Txt me with what I owe & I'll pay you". ( He already knows the amount). He has to come back cos he's left crap outside inc his crappy huge boat (did I mention he had delivered a huge boat last Sunday?) it's on the street! As well as a tool organiser wall & sundry junk!! All left on the curb at front of house!!! I said why haven't you got the money today ??? " The banks are shut on the weekend??? " Has he never heard of cash machines??? :(:(:(:mad::mad::mad:
    Continue the story tomorrow unfortunately!!! Will ask PManager what to do about mess tomorrow! List it out via txt to him with photos OR just leave it till QCAT application with the expected arrears he will prob do a runner owing. And can I demand he give me a forwarding address! Just had idea!!! Should ask him via text to give me forwarding address!! If he doesn't give me it !!! I have a record of him denying me this!!

    Gee, when I read all this I am so glad I leave PM to specialists...as if we outsourced to specialists, right? My health, time and life is so much better.....
    I hope lesson has been learned, sometimes we should let the specialists do their thing, so we can concentrate our energy on more important and vital things. Many don't realise but property business is also a team business (meaning we have vital people in our team!).

    Well I used to think it was fine to do it as I then knew exactly what was happening with my property.... but not anymore!! I'm sooo over it it's ridiculous! Yr right my time can be spent doing sooo many better, more productive things than dealing with idiots like these!.
