Garnishee Order For Debts Against ex-Tenant

    Hi,

    I'm currently in the process of filling out the forms required for garnishing a residential ex-tenant's bank account. I have a money order from NCAT already for $7453.78.

    Questions:
    - I don't have the ex-tenant's current address (just their email address and they have stopped responding)
    - I don't know which personal bank they use and therefore can't fill out the other parts of the form which ask's for the institution's address etc

    I have asked the ex-tenant by email for these details but no reply thus far. Can I still proceed with this?

    However, their still mail still comes into their old address some times and I saw a CBA business bank statement letter in the post so they seem to have a company bank account with CBA as a director. Can I nominate their business bank account (search shows they are a director) to pull funds from?

    No. the company doesn't appear to owe you any money.

    If you don't know account numbers you could subpoena banks, but this costs money each time
