Final occupancy certificate

    Hello everyone. One of our friends built a recent knock down and rebuilt. The issue is they used up almost the built up area for the house as a result the builder issued a interim occupancy certificate without a deck. Now the question is can they still built a decent size deck and get a final occupancy approved by the council in case it exceeds the built up area? Also checking if the deck can be approved by a cDC and will this count as a modification of the original construction plan for the house? Please advise as they are very confused. Thanks

    You're probably best to speak to a certifier.

    why not get final occupancy and then build the deck?

    You could do this too. In some areas you can build a deck (depending on size) without any approval at all.

    The issue is the house is on a slope and they will need some kind of stairs to exit from the property and there they preferred to proceed with the deck.

    Don't confuse built up area and landscape ratio.

    In the document of CDC they will have a compliance table showing how many open spaces / landscape are left.

    If you have enough then you can build extra deck.
    If not enough, then get OC first, then you do deck as Exempt development (check codes Housing Sepp 2008). Certifier or designer can help you point out.
