Fallen branches whose responsibility??

    Already fallen branches- to be removed from the yard
    Landlord or tenants?

    If you, as the landlord, undertook the responsibility to trim the tree, who would be responsible?

    I assume that you mean that you have existing tenants and aren't trying to pin the fallen branches on incoming tenants :p

    Can you get the tenant to throw them over the fence:p
    My neighbours tree loppers did this, they were a little slow they thought we would not notice.

    Wonder what would happen if the same tenant has been in there for a few years, managed by PM for interstate LL, who didn't notice/document trimming/lopping requirements etc, branch falls and kills someone?

    Ok, to simplify it, with out the kill/damage bit, who's responsible for maintaining trees, perhaps other than those requiring a cherry picker?

    General gardens maintenance = Tenant
    (Mowing, weeding, trimming the hedge, basic general stuff)
    Major works= Landlord
    (Annual trimming back those Pencil Pines, or anything that is bigger than allowed into the green waste bin)

    In pretty much all states as far as I know:

    1. If the branches are small and of the type so as it can be characterised as 'cleanliness' of the yard - then the tenant.

    2. Otherwise its almost certainly 'maintenance' and the landlord's responsibility.

    I've cut down a whole lot of overgrown branches -still heaps more vines etc which could/should be removed - but landlord refuses to pay for handyman to take them to tip or gardener to mulch. What do I do?.

    Or get the council tip passes or council cleanup off the landlord

    This is what a PM is paid for, inspections does not just mean the living area.

    If it is normal garden, without need to climb ladders and use chainsaws etc, it is tenant to maintain & or inform.

    Put them in the bins provided, slowly if a lot. Next time only cut what goes in bins if excess is a bother, or ask LL to do before taking place on ?

    Not sure if your joking, I do this all the time at my places, pain in the neck cutting things small, but.......

    thats what I thought would be the case, but then thought, what if it's not maintained, taken care of, becomes overgrown, LL is living interstate, no idea, becomes major costs to remedy, like a Dr or accountant after shiet goes wrong, PM shrugs shoulders, not costing me anything
