Chan & Naylor trademarked ?? Wonder if its as tested as hybrid discretionary trusts and the various claims about them over time.

I always have concerns when I see a TM beside a trust deed. Its not like common law can be trademarked. The effectiveness of a trust that seeks to transfer accumulating equity over time into a trust has to leave some exposure since the apparent mechanism that seeks to strip equity is a related party loan. There is also a time during which a clawback may apply. Could this expose the present and earlier trust interest ?

INDEPENDENT legal advice would be wise. And there are other similar options. Especially since C&N for example arent lawyers.

Most of the so called equity transfer trusts out there will not work. They involve gifting equity which will not work. There are even some lawyers promoting this ineffective methods.
