Duplex rear fence impacted by large tree

    A tree is largely responsible for damage to a retaining wall at the rear of our duplex property.

    Is it the strata responsibility and cost to remove the tree if necessary and to repair the retaining wall?

    Or is it the responsibility of the owner (us) on the side of the property where the tree is located?

    To make the issue a little more interesting, the location of the retaining wall is classified as an easement. Can anyone assist with this one?

    I would say yes, if your tree and it was allowed to do the damage, your cost.

    Step one is get the council out to approve removal so no further damage, then tackle the retaining wall issue.
