    In a similar position and instead of starting a new thread thought I'd post on the end of this thread.

    We have four IP's with a variable/fixed split (fixed portion until 2019). Although both in agreement as to how we would split the properties and their current value (we would keep 2 each of similar values), neither of us would likely qualify on our own to take on half the debt each.

    So my question is, would we still qualify for the stamp duty exemption if we were to delay this until 2019 when we are not locked in and hopefully in a better position (ie. both on higher salaries, greater rental income, better LVR)?

    There are time limits from when you split to finalising property settlement.

    Generally

    DEFACTO

    2 years from separation

    MARRIED

    12 months from issue of divorce decree

    Yeah right LarryLarrikin :) , that may work with Kimmi "the ice man", but most humans are emotional and also then greedy & not sure now, but solicitors used to encourage fighting it out.

    If people were that rational and level headed, they probably would not be at the point where divorce is the only option.

    In most cases people do listen but they soon forget what was said.
