Disruptive tenants in block of townhouses

    7 townhouses on one block with body Corp.
    Bylaws state 2 cars only and quiet enjoyment.

    Unit 3 has 2 tenants and a girlfriend with 4 cars which are parked in other peoples parks.
    They have their friends over most nights for a drinking party that lasts till morning. They are trashing the gardens.

    This morning the drunk tenant drove his mates home.. weaving out the driveway.

    Other units cant sleep at night.

    I suspect body Corp has no power. Theres another 7 to 8 months lease left on the lease.

    What do we do?

    Don't know about WA, but in most states there is a "quiet enjoyment" by neighbours requirement as part of tenancy - so they are likely to be in breach.

    There's probably all sorts of legal causes of action available. Including breaches of strata by laws. So I'm not sure why you suspect they would have no power.

    Has anyone even done anything about it yet?

    My experience with BCs is that they are are weak as.

    It takes ages to get anything done.

    You got to go straight for the jugular. And that means confrontation with these creeps. Unfortunately not everyone can do it. It can finish up on the 6 o'clock news.

    You've got to hound the owner of the property. And it's got to be a consorted effort.

    Lots, as below. And also depending on who "we" are:
    1. Talk/write to them (Councils and Police always advise this as first protocol)
    2. Property Manager to give warning, then Breach Notice
    3. Ditto to Body Corp
    4. Police

    Just start making loud noises yourself, starting about 7am the day after one of their all night benders, leaf blowers or lots of hammering are suggestions (too spiteful??)

    Well the owner lives in middle of queensland and doesn't respond to email.

    I guess that's a case of not in block.. the rents coming in so he doesn't care.

    The only real sanction is via the owners (e.g. breach of lease and eviction) so you need to make it real for owners. Warning and xCAT action ASAP.

    A property manager doesn't need the permission of an owner to breach in this instance I don't think as the agrieved party isn't them, it's you.

    Is that right @thatbum? Other people living there can ask the PM to breach or do they need permission from the owner?

    Hmm, hope you got the right email address. How about phone call?
    Really this should be a PM's job.. The Owner should really not need to deal with this if he already has a PM unless the PM is not doing his job.
    I find it rather unusual.
    Perhaps you can contact the other 5 Owners and submit a big Complaint to all of them.. PM, Owner, BC...
    Are you in the Committee at all?

    I'm the chairperson. This has been brewing for a few months.
    The block is in Townsville and everyone moned in at the end of last year. My unit is migrants who dont speak English.

    Two single owner occupied houses who keep the gardens well.

    Then 4 tenants units. 2 units are causing the issues. Unit 3care young blokes and havent learned that they need to live with other people.

    Dont have any other contact for the owner of 3.

    PM has sent them a complaints ignore. They replied to say it was nonsense and that was that.

    Sorry you had to deal with this situation. Some people are not suited to live in a Complex.
    I guess other than keep pestering the PM and Owners, next step would really be the Police but unsure how effective that would be.
    You can get the BCM to issue Breach Notice, and have some evidence ready. Might have to breach all 3 (Owner, PM and Tenants)
    Not fair to others who abide by the Rules....

    Who is making you aware of the issue? These noisy tenants are in your unit?

    The neighbours need to call the police for the late night parties. Once that happens a few times, they might settle down or move out. You could let your PM know you'll release them without penalty.

    Could we charge $10 per car per night for any car above 2 staying on the property?

    Or do a two away of spare cars?

    Nah that's not really right unfortunately. There are some issues for the owner though if they don't do the right thing in terms of cracking down on their tenants though.

    @Adelaide I can't be bothered typing everything out that you could and should be doing, but if you PM me I can give you a call later and explain.

    Honestly you have lots of potential options, especially as the chairperson of the strata, I'm sort of flabbergasted that you're stuck.

    Maybe there's something I'm missing, shrug.
