Delayed Settlement

    Hi,
    Our settlement is delayed by 4 months and we purchased off plan, however the place is all ready to go, I think there are only kitchen appliances have to be put in, every time we are calling agent, he says it's going to be ready next month or the month after, but nothing is happening , I just don't know what else we can do or speak to. Thankng you for any advice

    What are the issues holding up completion? Occupation certificate, registration of strata plan, outstanding approvals etc?

    The agent said they haven't finished it yet , it took them
    3 months to do driveway and carpets so only appliances are not done for now. But he didn't mention any other reasons , also the agent says that he doesn't know when it's all going to be done even he promised it's the big inning of October this year . I just don't know if we can get out of it without loosing our deposit ...my accountant says that we have to wait

    I guess I will need to see a lawyer as I don't have one .just conveyancer and an accountant

    Is a sunset clause that allows the developer to pull out?

    Why would your accountant be advising on this? This is legal advice.
