that is true - to be honest, defamation is hard to prove esp when you are dealing with personal experiences and there has been no personal character attacks and solely based on your facts.

    Its definitely a grey area.
But if you can prove it then you have a case. This is from another forum
Australian man successfully sued for defamation on online discussion forum - inthemix Forums

My g/friend had to pay out her ex employee $50,000 and a formal apology in the newspaper.

If you have evidence and you have the money to proceed then it can happen and does happen.

    MTR:)

Yeah, if you read the article linked to on that site - it's pretty clear that the "news" was about the fact that the guy thought he was anonymous but they found him anyway - not that what he said wasn't defamatory.

There's a lot of people posting stuff on websites which is clearly defamatory and just assuming they can get away with it because of internet anonymity.

If what you are posting is A) true, B) a description of your personal experience, and C) not overly emotive, calling people names or alleging criminal activity and such ... then there's no real grounds for defamation.

I have no interest in facilitating anonymous defamation on my site - but I absolutely encourage people to share their stories and experiences for the benefit of others in our community.

I know of people getting sued for accusing someone being of a sexual nature (gay lesbian) but not for not for legitimate experiences like for e.g.

"I had experience of paying X dollars for service which I thought was too expensive. The service is very poor and the person Y who was allocated to me did not give the service as required as the yields and selection were incorrect in prediction of growth etc. I think the person did not engage the correct details as per the brief and after 2 years the growth is X% and the yield is Y% which is below industry average. Also upon requesting clarifications, no emails etc were answered etc."

If this was the case American airlines and other all other service providers would be sued

Of course Don't get personal and insult the individual talking about his family characteristics. Like saying for e.g. Mr Y was a fat black $%^ of course that would get you into deep trouble.

The guy quoted is talking about class actions in the main.

He provides no evidence for his comment that Australia and Canada are the second most litigious...
