    Well, you have more costs, I would speak to PM about raising rent as said, if allowable, then work out what is fair, if the PM says they will or have been looking at or complaining about other things as a way to punish you or be unreasonable, then I would be asking about giving notice, after the rental increase (or at the same time rather).

    I am surprised they would ask you to do this if you already put a new dishwasher and also had service guys report no issues ?

    This is what I was thinking - the OP has actually been ordered to make the specific repairs, after what appears to be actual reports done on the issues as well.

    Another side to the story could possibly be that the OP is a stingey landlord who refuses to make proper repairs to their property, and is a sore loser at VCAT - now trying to get out of having to comply with the decision of tribunal.

    I would tread carefully in attempting to issue a no-grounds termination notice.

    There is no date shown on the tribunal order so we don't know if it was issued before any work was done.

    It seems likely that it was issued before, as if the dishwasher had been replaced then surely no report would be needed.

    Why not just do the repair and see how things go? Some tenants can be a little vocal at the start but once ya get the house up to acceptable standard they're good as gold.

    So for month-by-month, the landlord has to give 90 days but the tenant can move out the following month?

    (assuming periodic means month-by-month - please correct me if I am wrong)

    Yes periodic and month my month are the same thing.
    I'm SA landlord can give 90 days with no reason, 60 days with a reason ir renovating.
    Tenant can give 21 days within the 60 or 90 days

    If they slip over when one of the titles lift ,and the insurance company tells you "no-can-do" then money wise it will be harm-full to you..

    Yes, there are various threads and opinion on why PM should be on top of making sure there is a fixed lease, this provides a better & fairer outcome for all I feel.

    Yes, if work etc was only done after order, then that explains a lot, if tenants raise legit things, you have to do something or negotiate an agreed outcome. That does not make them a bad tenant, but a LL also has to watch what they spend, all our tenants get to have things fixed straight away or in short order, while we often have to wait a long time or no do some things at all.

    If tenants want to be very fussy in what is an average or older home, then I would think they are a pain too, so this stuff goes both ways.

    Thanks all your comments. But i'm very frustrated with all of these. i asked agent to carry out all the repairs and waitting insurance claim to replace the carpets.

    1. Tiles are not even lift- Just the sound comes under - Order to reseal - No Harm at all.
    2. Dishwasher - Second cycle - Order to service - No idea why if the manufacture service and confirm?
    3. Carpet - Water damage the area - Again no harm but they have done the damage

    4. Ensuite - House got full ducted heating..

    Last two b4 the rent....

    Did you produce evidence refuting the claims?

    You didn't go to the hearing deciding the issue? Why not?

    How do you know the tenant's concerns aren't valid then? The tribunal seemed to think so.

    What a drama.... PM called and told me that tenant don't want to reseal and ask tradesmen to leave and they need new titles???

    Electrician complained about racial abuse and not want alternate solution and they want to fix the heated floor tiles????

    Only Insurance company plumber check all the carpet issue..


    Is that my house or their house .. LOL

    Easy answer - their house for the period of the tenancy. That's what a tenancy is.

    It also sounds like some very experienced tenants and a newbie LL.
    OP, you said "they" damaged the carpet, then later you said it was water damaged, please clarify ?
    The tenant is sounding picky though (re wanting tiles replaced) next thing you know they will be wanting landscaping done :rolleyes:
    Is the current rent "fair market" price ?
    When was the last time you raised the rent ?

    If the tenant turns away trades that have been organised and agreed to then that (imo) should be at their cost for service call.
    If the tenant is being rascist, ask the tradie to send you/PM a written complaint ;)
    Leave all interaction with the tenant to your PM from now on.
    Document everything ready for your next date in court (and appear)o_O

    Sounds like there has been water damage which has made the tiles drummy and damaged the carpet.... perhaps also damaging underfloor heating in the ensuite.

    If this is the case the tenant is in the right to have these issues fixed... presuming the damage was caused by an issue with the house and not something they did.

    I think it is time you sat down with the PM and got to the bottom of what is actually going on at your property.

    I have a sneaking suspicion that things are actually worse than you believe, or have been told.

    If still unsure, go and talk to your tenant without the PM present.

    There may be issues between the PM and the tenant.
