Conveyancer/Lawyer for selling property

    When selling property, is the quality of the conveyancer or lawyer that important as all they're really doing is creating a contract of sale. It's not like when you're buying a property that you need a good one. Thoughts?

    Also, typically what price do they charge when selling a property in NSW?

    They do much more than just create the contract of sale if things go a little bit strange. For instance, what if the buyer wants an early release of deposit, there is an insurance incident during pre-settlement, arguments on chattels and inclusions, repairs, the buyer can't/won't settle etc

    If all sails through then it can be pretty easy. It is when it goes wrong that you want someone good. I would go (in order of preference):

    1. a lawyer who just does conveyancing (not the only thing the firm does, just that their lawyers only do that);
    2. a conveyancer;
    3. a lawyer who is a generalist or only does some conveyancing.

    I recently had a transaction where the sellers conveyancer was of the budget variety. The charge a basic fee a bit over half what most conveyancers charge.

    The process didn't go smoothly. The conveyancer seemed to charge a lot of extras most of which were completely unnecessary. Delays were also introduced and penalty fees were charged, they attempted to pass on those penalties to the purchaser (not that we let them get away with it).

    Do you really want to risk a transaction worth hundreds of thousands, sometimes millions of dollars, on a few hundred dollars of cost?

    On that note, does anyone know of any good conveyancers/lawyers they recommend in the Sydney area and if known, rough prices?

    I'd be of the view they are more important when selling than buying. If they stuff up something in your section 32 its better they are held responsible than you, especially if the property is in strata/body corp.

    Great words of wisdom. Couldnt agree more. You pay $1800 to insure a car why not insure yourself with good legal representation. When it goes pearshaped a convenyancer will tell you to see a solicitor anyway. The lawyers in group 1 are often price competitive anyway. Its the ones in group 3 who are often exy.
