NSW Co-tenancy changes - new lease?

    My property is currently being co tenanted. One of the room mate is going to move out (before lease ends) and the other party has agreed to cover the rent until they find a new room mate, do I need to have the agent draw up a new tenancy? Is there anything particular I need to do? When they find the new room mate, do I have to draw up another lease again?

    Are you self managing?

    The remaining tenants continue to pay full rent and when they find someone to replace the outgoing tenant you need to accept them and you can add them to the lease without doing a new one.

    Is the outgoing tenant listed on the bond form?

    No it's through an agent. They are on the bond form. So the agent just amends the existing lease by crossing out and initialling and adding the new tenant in?

    i don’t know. How do they get the new tenant onto the lease and the Tenant that moved out off the lease? Are you saying nothing needs to be done and they don’t need to be recorded on paper?

    Nothing *needs* to be done. It depends what legal relationship you want with the new occupant, the remaining tenant, and the outgoing tenant. There's pros and cons to a number of different options.

    Are you 100% on the order? :p

    It's easy enough to vary the lease - outgoing tenant to relinquish their tenancy and new tenant as replacement tenant. Let your agent deal with it.

    You want to get written confirmation from all parties that one intends to come off the lease, then make sure the remaining tenant can service the rent without the second tenant. You don't need to change the physical lease and the tenants should organize their own bond change. When the new flatmate comes along, they apply through the normal process.
