I made the mistake of insuring with a non-specialist (Allianz) for landlord insurance. Now that my bad tenants are evicted, i'm trying to recover costs. Do insurance companies typically require an eviction notice to be issued within a specific timeframe? I ask because, if i include the applicable bond as part of the money paid by the tenant, it makes it 6 weeks before an eviction notice was issued. If i treat the (unpaid) bond as separate, they were two weeks behind when the notice was issued. Are there any other pointers you can give concerning claiming on landlord insurance?
Yes they do sometimes ask for an eviction notice and costs to change locks etc.. Dates need to be handled correctly. Allianz applies an excess to arrears claims. Switch over to Terri scheer, they are the best ones I've dealt with lately.
You have a duty to the Insurer to minimise any possible arrears - that means that all notices/breaches/evictions etc must be done as soon as possible and in the manner dictated by the local governing body. If you have not done everything by the book they will reduce your claim for anything that is non complying.
You will have to show that correct notices were issued as soon as legally possible, and may be asked to provide copies. You may also be asked to show how the bond was used if not put towards unpaid rent. Marg
