    What might be Brisbane’s cheapest river location, has hit the market - realestate.com.au

    Be very surprised if the headline is true.

    DA to demolish was knocked back by BCC (not my town planning practice but would have had same result). My law firm appealed the demolition approval and won. Great return, fixed price appeal with us was $16k plus GST (inc court fees and Barrister), he (as in owner) reckons its worth $1m more with the demo appoval in place.

    What was on there before and why was it demolition controlled?
    And on what basis was the demolition approved?

    There was a different pre-1946 dwelling on the site but it had been moved off.

    This dwelling was moved from Nudgee Beach and was built before 1946.

    There was also a belief in council that it had been in Sherwood/Toowong prior to Nudge Beach and was built prior to 1911.

    It was located in the Local Character sub-precinct of the Traditional Building Character Overlay.

    The overlay deals with buildings constructed prior to 1946, so although not located on that site, BCC argued that the dwelling was constructed prior to 1946 and that relocation of said dwelling did not alter that characterisation.

    Construction date and relocation has never been tested in the P&E Court.

    Very short version of why approval given is that we made a thorough, well reasoned argument, regarding construction and relocation following the first mediation. BCC was then not prepared to test their position versus ours in the Court and so consented to demolition.
