Change of Family Trust Address

    The original family trust with the corporate trustee has a registered QLD address. Stamp duty was not required in QLD. I want to change the address to my current home address in NSW now. There is an investment property under the family trust. Do I need to pay stamp duty if I make the address change? NSW requires stamp duty for a family trust registration.

    Trusts are relationships. they are not registered. If the trustee has moved the trustee can change its address with ASIC, ATO etc

    NSW does not require duty on trust registration, only on the settlement of a trust. Trusts are not registered in NSW.

    If the trustee moves to NSW there would be no stamp duty payable if the trust was already settled - established.
