Certification of family trust deed

    Who can certify a family trust deed in NSW? Shall I just photocopy the government stamped deed and have a qualified person certify it by stamping every page of it? It seems like a lot of work for the certifier. I am wondering whether a JP or police officer is willing to do that.

    for what purposes?

    a five year old kid could do it, but it will depend on what it is being done for and whether the recipient would accept it. If for lending purposes generally a solicitor or JP but bank staff might be acceptable too.

    Thanks, Terry. It is used for purchasing a property. We are getting a bank account for the family trust and the bank asked for a certified copy of the trust deed.

    • Chartered Accountant
    • Magistrate
    • Officers of Revenue NSW
    • Public notary
    • Commissioner for Declarations
    • Member of Parliament
    • Police officer
    • Pharmacist
    • Minister of religion
    • Medical practitioner
    • Dentist
    • Veterinary practitioner
    In some cases, not every page needs to be certified, just the signing pages but check with the bank regarding what they require.

    The banks usually accept certifications by accountants.

    I haven't heard of them asking for the whole deed for identification purposes before - usually it is just the pages with the name of the trust, date of establishment (maybe names of parties to the deed?) & signature page. Is this in regards to a borrowing (so they can see what the powers of the trustee are)?

    There should be no reason for a certified copy to just open an account.
