Can the notice period for rent increase be within fixed term period?

    Hi,

    In NSW, can the 64 days notice period for rent increase be within fixed term period, with the rent increase only effective when fixed term period expires?

    Yes, any notice can be issued during the fixed term but only some can take effect during the term eg: breach. The increase cannot take effect during the fixed period.

    But is it ok to increase the rent during the fixed period if tenant agrees in exchange eg for an air cond?

    Normally you can terminate the existing lease under mutual consent - but I’d get this in writing first and double check fair trading, my experience is only in Vic.
