    What are the seller laws in Victoria regarding paying agent commissions when property didn't sell, was taken off the market, and later purchased by someone who enquired about it when it was listed but never inspected it?

    Short story is that you will probably owe the REA his/her commission depending on the SAA (selling agency agreement) you signed. Go back and have a good read of it. If it was sold by a different agent the second time around you may actually owe 2 commissions- 1 to each agent.

    The long story is that if you feel like going to court to avoid a commission being paid, you’d better have deep pockets and a lot of time and emotional energy to burn. Google <effective cause of sale> in relation to real estate in your State.

    Check your agency agreement. The agreement is usually only valid for 90 days and I am also pretty sure you are entitled to sell the property to another person directly during the agency agreement period so long as it was yourself personally and not another real estate agent.

    Most agreements include any purchaser introduced by the agent, even if they buy after the agreement ended.

    Check the agreement carefully, especially if another agent involved.
