Hi, I have a property in QLD that is not currently rented out. I am waiting for quotes from the property manager to have repairs done before they can rent the property out again. Can someone please tell me if I can break the property management agreement if there is no tenant or do I have to give notice before I can go to another agent? Thanks in adavnce
The property management agreement usually has a fixed term period not dependent on a lease agreement. That’s why people can switch managers mid lease
The simple answer is that you will have a fixed thirty day termination period. However, there's nothing stopping you from engaging another agent. It's most common practice for outgoing agents to hand keys over immediately on vacant properties, as there's no reason for them to continue management of a vacant property.
You must provide written notice of your intention to terminate. Given it is vacant, you could request for the termination to be effective immediately and see what they say. At most, they can insist on 30 days notice (like Tomas said).
