Are councils obligated to pat 50/50 split in a fence

    We have a SIDE fence between our property and our neighbour,
    The first 10 metres of the side fence fronts council land / footpath - quarter bowl of street corner

    Council instructed as part of our planning permit & subsequent townhouse build that we would have to pay 100% for the fence between ourselves and our neighbour.
    Should I be asking council if they (council) will pay 50% for the part of the fence that runs along the footpath, or am i wasting my time...

    Well I know in Sydney the council doesn't pay half as far as I know. I know one fella who lives on a corner and was so peeved by council refusal to pay half that he doesn't cut the nature strip grass.

    Is this for an existing fence , or are you doing a development and need to knock down/replace the existing fence.

    I very much doubt there is a council in Australia that would contribute to the fence :rolleyes:

    Check the Victorian Dividing Fences Act. There is usually an exemption for councils except for sites where the land is classified as 'operational land' ie a car park, council facilities/offices/depots etc not parks or walkways.

    What? We now have council officers patting fences..... I knew they were different in Victoria!

    Haha... I'd be happy to pay for the entire fence just to avoid council coming out to my site unnecessarily!

    did he get a notice from the council saying that if he doesnt cut their grass, he will be fined for breaching the peace:D

    No. Actually the council cutter comes around every now and then and cuts the grass - a 5 minute rough as guts job.
