    Does contract law prevail In this instence or just a different remedy?

    i'm not sure what the question is.

    my post wasn't about the op, just your assertion that a deposit is required for a valid contract.

    1. A deposit is not consideration.

    2. it was Supreme Court's interpretation/application of the Electronic Transactions Act QLD 2001 that made contract enforceable. There are several cases (some in other states) since that support the decision

    3. If you don't want your email exchange to form a binding contract then that should be explicitly stated.
