    You need a legal basis to "ask the court" for an easement. You don't appear to have any.

    Could possibly request a prescriptive easement (lost modern grant) through the court system. Basis of request: 30+ years of continuous use. Also probably an expensive route, and it looks like NSW has another option which BMC outlined earlier.
