QLD Advice for dealing with tenant from hell

    and shes asking for compensation?!?! what a turkey

    This is why some tenants make my blood boil,
    they leave the place a mess, dont pay utilities, dont pay rent, and yet have the audacity to ask for compensation of $20

    are they expecting it to still be paid to them despite all the arrears?

    lol....like most of them, it is a BS situation, seeing we have been user pays for decades.....

    Well, to answer your original question then- you should not be worried. Let her take you to tribunal.

    Am surprised courts dont turn around and laugh them out

    Or turn around and say "ok we willl award you $5 in compensation, but you still owe $500 from rent so so deduct it from there so you still owe $495, if you dont pay we will send it to debt collectors

    Without prejudice and based on the facts presented-

    Can’t claim water on a non compliant property, that’s pretty clear and lesson learned for next time.

    In regards to the repairs, although inconvenient to the tenant, I believe it comes down to the individual whether or not you should offer compensation, I don’t feel it is appropriate to offer compensation for some repairs to the bathroom if the repairs are only for a period of seven days.

    Different story if you are having to replace the roof or something where half the house was in- usable for a period of weeks.

    I think the bigger question that should be asked is why isn’t your managing agent helping you with the process, it sounds like they’ve led you astray.

    In the order of all fairness, ask the tenant what she proposes to be a fair and reasonable amount of compensation, doesn’t mean you need to agree to it, but it least I can give you an idea of what you expect before you need to take the matter any further.

    Some people might laugh at my next statement, but a $50 Bunnings voucher/gift card has got me out of a jam many times.

    I tabled my response before I saw this reply, clearly I don’t think it’s worth compensating someone for two days of inconvenience.

    In Western Australia the property owner can arrange for Water Corporation to invoice tenants directly for water consumption.

    Yes sorry my statement above wasnt correct however in WA the bill if unpaid still remains the responsibility of the landlord which isn’t the case in VIC.
