2 storey granny flat stupid requirements

    Hey guys was hoping if anyone knew why the requirements to build a 2 storey granny flat cannot exceed 60square metres in total. I personally think its very stupid. I mean i can understand certain reasons such as land size issues and sun light blockage to neighbors. But why restrict it to that limit seems kinda ******** to me. If anyone knows why could they explain thanks.

    Hello Joskies, Not sure about the reasoning behind this, but on the other hand, l've seen some really clever small plans been developed lately.How big were you hoping to go?

    The 60m2 is the limit for a complying development that can be built without council involvement. You can always put an application to council for something bigger.

    What's wrong with the go being situated over a garage with the laundry in the stair void? Garage isn't counted.

    While in some states it is now permitted to rent a granny flat to a party unrelated to those residing in the main residence... historically, the granny flat was intended for an elderly or dependant person related to someone living in the main residence. An elderly/dependant person isn't likely to be up to maintaining & cleaning a large abode, so council probably considers that 60m2 is more than enough space for a dependent person to take care of.

    Going by your reasoning, FSR shouldn't exist at all and everyone should be able to build the Burj Khalifa in their backyard without requiring a DA.

    @Scott No Mates not sure what you mean, but yes, historically granny flats were not intended to be rented out.

    Whether it's ground floor or double storey 60sqm has traditionally been the amount of space to keep it from being too house like. If someone let you have 70sqm plus you'd be cramming 3 bedrooms into it and creating a small house

    In Perth they did increase it from 60 to 70 sqm and the 70sqm ones are now often 2 bedrooms, 2 bathrooms which are nice and do offer some needed diversity to the neighbourhood. I doubt anyone would allow more than 70 here as then they will become 3 bedders and we don't need more of them.

    If the area isn't zoned to subdivide and you can only do a granny flat then embrace your 60sqm with good design and clever solutions.

    In most instances you are correct but there was also case law in NSW where if the resident had use of the garage or some benefit from it, they were going to count the garage floor area. So proceed but with caution.

    It's all in the detail. Some development is based on fsr, others on gfa. However the inclusions and exclusions from the measurements is just as important eg. Stairs, storage, parking etc.
