16m2 off R3 Zoning - Thoughts ?

    Hi All,

    Interested in peoples experience

    Current size is 16m2 off R3 Zoning
    There is a R3 Zoning on the right and R2 Zoning to the left of the property (they have subdivided into 2 lots)

    What are the chances of getting to R3 or too hard to tell ?

    I had a property once that by title was 3sqm off being subdividable.
    Paid for survey
    Came in 4 sqm over min :D
    Sold 6 months after purchase for $75k profit, thanks to survey and being lucky i guess :rolleyes:

    Apart from a survey, any chance of applying for an exception/variation

    I was just reading up on the councils website around variation - It is possible and specifically talks about R3 zoning and takes into account neighbouring properties
    Just doing some initial sums

    We've had sites that sat just outside the required ratio for certain developments, but managed to get them through DA. Most councils have a little leeway. Ask them.

    According to their zoning map all the street is R2, but I know the street well and can clearly see on Google Maps there are Villas/ Townhouses up and down the street. Am I missing something ?

    Read the LEP. Not all council plans are the same or exemptions may have been granted.

    The LEP changed as they deemed it not suitable for townhouses anymore- I think you would be having a tough time getting it through, Possible but might be too much work

    Talk to council ( and not just the people at the front desk ...)

    We've done two subdivisions in Ku-ring-gai which didn't comply with the guidelines , but were close .

    Also try and find a local expert to get advice off .
